Acceptable Use Policy

Wynshop’s Acceptable Use Policy (“AUP”) outlines activities that may and may not be engaged in by Customer through its use of the Wynshop Digital Commerce Services.
Customer shall use the Wynshop Digital Commerce Services exclusively for authorized and legal purposes, consistent with all applicable laws and regulations, subject to the restrictions below.
Customer agrees that it will not use the Wynshop Digital Commerce Services to:
1) Post or upload any content or data, which
a. is libelous, defamatory, obscene, pornographic, abusive, harassing, or threatening;
b. violates the rights of others, such as data which infringes on any intellectual property rights or violates any right of privacy or publicity;
c. introduces malware, or engages in phishing or similar malicious activities;
d. promotes or condones hate, discrimination, abuse, intolerance, terrorism, or violence in any manner, either directly or indirectly;
e. otherwise violates any applicable law or promotes the violation of any law.
2) Interfere with or disrupt networks connected to the Wynshop Digital Commerce Services.
3) Offer goods or services, or post or upload Materials (“Materials” include photos, images, videos, graphics, written content, audio files, code, information, or data) that exploit or abuse children, including, but not limited to, images or depictions of child abuse or sexual abuse, or that present children in a sexual manner.
4) Engage in price gouging, deceptive commercial practices, or any other illegal or deceptive activities.
5) Post or upload any Materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords (unless you have explicit consent from the person to whom the information belongs or who is otherwise authorized to provide such consent).
6) Collect, store, or process any protected health information subject to the Health Insurance Portability and Accountability Act (“HIPAA”), any applicable health privacy regulation, or any other applicable law governing the processing, use, or disclosure of protected health information.
7) Offer or promote weapons.
8) Offer goods or services, or post or upload Materials, that promote self-harm.
9) Transmit unsolicited commercial electronic messages (Spam).
Wynshop may remove any violating content posted on the Wynshop Digital Commerce Services or transmitted through the Wynshop Digital Commerce Services without notice to Customer. Wynshop may suspend or terminate any user’s access to the Wynshop Digital Commerce Services upon notice in the event that Wynshop reasonably determines that such user has violated the terms and conditions of this AUP.
Customer acknowledges and agrees that Wynshop does not monitor or police the content of communications or data of Customer, or that which its users transmit through the Wynshop Digital Commerce Services, and that Wynshop shall not be responsible for the content of any such communications or transmissions.
